In Q1 2024, we took a look at the Equal Employment Opportunity Commission’s (EEOC’s) proposed guidance on harassment in the workplace. The EEOC has since released the guidance as final. While there are not many “surprises” in the final guidance, it does formalize EEOC’s longstanding stance on the subject (as the guidance was last formalized over 20 years ago). Business Takeaway: While the guidance does not create new law and is not binding on the courts, it can be a useful tool as EEOC is essentially broadcasting what it considers “the rules of the game,” including hypotheticals and other examples.
