FLSA Salary Threshold May Rise

The Trump-era Department of Labor (DOL) raised the Fair Labor Standards Act (FLSA) white-collar exemption salary threshold to $35,568 (annualized). Biden’s DOL  is now considering raising it further. Former Wage and Hour Division Administrator Tammy McCutchen predicts a desire to raise the threshold to $48,000–49,000 (annualized), a sum previously entertained but never implemented.
